TERMS AND CONDITIONS
As stated in the Application Form, each member should be RESPONSIBLE in using the Card.
RESPONSIBILITIES OF THE MEMBER
The Terms and Conditions stated herein, as defined by AP Blue Whale Corporation and MAXXIS Tires (herein referred to as APBW/MT) forms the basis and guidelines of the issuance of the MAXXIS Adventure Team Exclusive Card (herein referred to as MATEC), defines the rights and obligations of the Member (herein referred to as the “Member”) in the MATEC membership and loyalty program, and provides for the collection and processing of personal data by APBW/MT and its parent company, subsidiaries, affiliates, agents, and partners (herein collectively referred to as “Service Group”), among others. Members of MATEC are subject to these guidelines and are deemed to have accepted and agreed to any and all of the Terms, Conditions, Guidelines and Rules thereof upon signing the Membership Application or applicable form.
MAXXIS Adventure Team Exclusive Card (MATEC) Membership
Membership is valid for two (2) years from date of application. Membership must be renewed before expiration in order for members to continue enjoying the benefits of the MATEC membership.
In the course of the membership, APBW/MT may request to provide and/or update Member’s personal data. The Member agrees and hereby gives consent to APBW/MT and its Service Group to collect, store, access, share, process, and/or destroy copies of his/her personal data including any updates or changes thereto, whether manually or electronically, for the period allowed under the applicable law and regulations, for the purposes of the MATEC membership, including any renewal thereof, as well as of conducting marketing and customer profiling activities in connection with APBW/MT’s services and related products, and issuing or sending related notices, updates, service or administrative announcements.

5% discount for every purchase of MAXXIS Tires and its affiliated brand such as CST and PRESA tires for PCR/ SUV category.
1 year Tire Protection Plan.
Special invitation to one of the MAXXIS/CST/PRESA events or receive a merchandise item once a year.
Be updated on the limited and exclusive promo to its members.
Carry the MAXXIS Brand in their car clubs as their tire partner.
Tire Protection Plan
1 year coverage of the Tire Protection Plan only for the tire category patterns of PASSENGER CAR (PC), All-TERRAIN (AT) and HIGHWAY TERRAIN (HT) with wheel diameter size of 15 inch and above. Patterns M9060, MT772, MT764, CL18, CL28, Sahara MT II, PJ33 (PRESA) and other trail off-road tire patterns are not included.
Only the tire/s purchased using MATEC shall only be covered by the tire protection plan.
Damaged tire/s should be brought to the store where the purchased was made and shall be subjected for inspection and review of APBW/ Maxxis Tire Technical person.
The tire protection plan shall be applicable under the following conditions:
If the tire is repairable, APBW shall cover the repair expenses.
If the tire is beyond repair but the remaining tread depth is more than 80% from the original tread depth, APBW will cover 100% replacement of the tire with the same pattern and size.
If the tire is beyond repair but the remaining tread depth is less than 80% of the remaining tread depth, APBW will cover the computed amount based on the remaining tread depth measured. Replacement of new tire/s shall be discounted based on the consumed tread depth.
In reference to the safety standard tread depth 1.6mm shall be subtracted on the current tread depth of the damaged tire/s upon computation of the warranty claim. (1.6mm is the tread safety tread depth standard followed by Maxxis International)
Only one time replacement is allowed for each tire in every set of tires (2pcs or 4pcs) purchased by the card holder. The same tire which was already claimed for replacement will not be honored for another replacement.
Tires purchased for commercial purpose such as rent a car service, Grab Car, Taxi or delivery are not covered by the tire protection plan.
Definition of Road Hazard:
A set of tire damage that caused premature removal or end of service of the tire.
(Tread cut or puncture, Sidewall Cut or puncture, Sidewall shock rupture due to contact)
These damages occur when running against road hazard such as potholes, rocks, curbs, metal or glass.
When claiming for the warranty the card holder must present the copy (digital or original copy) of the proof of purchase such as the invoice or official receipt and the valid membership card
Claiming for the warranty shall only be within the period of membership validity of the card.
The Member agrees to receive verbal, written, or electronic communications from APBW/MT or MATEC group.
Each Member is obligated to keep his/her information or personal data file up-to-date and correct by reporting any change or correction in name, address and other data. Members shall do so following the process stated in the Member’s Application Form and through its touch points, including but not limited to , , or through the following hotlines: 805-1191/877-6819/837-4550 (for Metro Manila). Member understands and agrees that APBW/MT shall not be liable for any loss, damage, injury or claim arising from his/her failure to keep updated or to correct his/her information or personal data file.
APBW/MT reserves the right to store personal data of its members where APBW/MT consider it necessary or appropriate for the period allowed under the applicable laws and regulations.
Membership will be terminated automatically and all benefits and privileges void upon the death of the Member.
Use of the MAXXIS Adventure Team Exclusive Card
The Membership Card is not transferable in any circumstance, and is valid for use only by the Member who must present it when conducting any transaction. The Member may not use this Card for any transactions of other customers.
In case of lost or damaged Membership Card, the Membership Card maybe replaced by APBW/MT. The Member agrees to immediately report the said incident in writing or by calling the APBW/MT Hotline Number immediately to report the lost MAXXIS Adventure Team Exclusive Card.
Changes to the MAXXIS Adventure Team Exclusive Card
The Terms and Conditions cannot be superseded or changed except by APBW/MT. APBW/MT shall use reasonable endeavors to provide Members with accurate and timely information regarding the MATEC membership including any changes thereof.
APBW/MT reserves the right at all times, without notice and its sole discretion:
To make any changes whatsoever to these Terms and Conditions including the rules and guidelines in the Member’s Application Form;
To withdraw, cancel, withhold, substitute, deny access to or use of, or in any way change any of the Benefits or Privileges previously advertised or offered, to any Member, at any time, without prior notice, and APBW/MT will not be liable for any loss or damage suffered by the Member resulting from such withdrawal, cancellation, variation or change.
These Terms and Conditions shall be governed by the laws of the Republic of the Philippines.
All questions or disputes regarding eligibility for membership in MATEC or eligibility for accrual or redemption of Benefits or Privileges will be resolved by APBW/MT at its sole discretion.
Failure of APBW/MT to enforce a particular Term or Condition or Guideline does not constitute a waiver of that Term or Condition or Guideline.
MATEC and APBW/MT are not suppliers of the products and services shown as Awards or Privileges and will not accept liability in relation thereto.
The Member is solely responsible for the use of any Benefits or Privilege; whether the Benefits or Privileges is used by the Member or by a third Party.
The Member hereby understands and agrees that the successful operation of MATEC is based on the cooperative interaction among APBW/MT, the Members, and APBW/MT’s Service Group. The Member also hereby understands and agrees that proper implementation of the Terms and Conditions between APBW/MT and the Member is closely related and/or intertwined with the proper implementation of the Partner Agreement and/or Loyalty Marketing Agreement between APBW/MT and each of its Service Group.
Consent of the Member
The Member understands and agrees that by signing the applicable form or, in the case of online or electronic processes, by clicking the applicable icon or button , the Member is giving consent to APBW/MT and its Service Group, if any, to collect, store, access, share, process, and/or destroy copies of Member’s personal data, such as but not limited to his/her name, IDs, age, contact details, and other personal data, including any updates or corrections thereto, whether manually or electronically, for the period allowed under the applicable law and regulations, for the purposes of loyalty program account management, direct marketing, analytics, service or administrative announcements related to system enhancements, program updates, discounts, promos, sales, advertisements, events, marketing activities and commercial communications, and offers that APBW/MT deems beneficial to the member, as well as to the publication of Member’s name in relation to promotional efforts and any automated decision-making that may or may not significantly affect the Member (collectively referred to herein as “Purposes”).
The Member is aware of and understands his/her rights under the Data Privacy Act, including the right to request access and correction to the personal data related to him/her. The Member likewise understands and agrees that while he has the right to object, it is necessary for APBW/MT and its Service Group to collect, store, access, share, process, and/or destroy copies of his/her personal data for the aforementioned purposes as well as in relation to his/her Membership.
